If you were to be convicted of possession of marijuana, you would be subject to a six-month driver’s license suspension. In order to get your driver’s license back, you would be required to take a 15-hour drug education class. If you want to keep your driver’s license and do not want to be required to get an occupational driver’s license during that period, then you want to avoid a conviction at all costs. There are a lot of ways that you can avoid a marijuana conviction by working with your attorney. Ideally, if a dismissal were not possible, you would be offered deferred adjudication probation. Deferred adjudication probation is probation without a conviction.

Deferred adjudication is probation that you can get sealed from your record after you successfully complete it, so that only law enforcement or a prosecutor can see it in the future. It does not come with a driver’s license suspension. Under the statute, even possession of drug paraphernalia is defined as a drug offense and unless you get a deferred disposition on it (the ticket version of deferred adjudication), your license will be suspended. If you got a deferred disposition, you would not have a conviction or a driver’s license suspension. If you take a conviction for possession of marijuana or for drug paraphernalia, the DPS will suspend your driver’s license. You will also need to take a 15-hour drug education class.

If you do get your driver’s license suspended, you should be eligible for an occupational driver’s license, assuming that you have not had two or more occupational driver’s licenses within the previous 10 years. Then, you will be able to drive to and from work and other necessary activities during the period before you get your regular license back.
