Phoenix Court is a Travis County specialty courts program that has been in effect for the last couple of years. It offers housing, job, drug abuse, mental health, childcare, transportation, and a number of other services in an attempt to restore stability to women who are charged with prostitution, and generally lasts about one year. This program is only offered to female defendants, and there was one example of a male to female transsexual defendant who was allowed entrance into the program last year.
If you complete the program, then the prosecutors will dismiss your case and you will be entitled to an expunction. The program is also open to those who engage in prostitution but have not been charged with it. The only problem I have with this program is that male defendants are not allowed entrance, and there are no similar programs for men. This results in a Fourteenth Amendment equal protection among the sexes violation, and is another angle of attack for prostitution cases with male defendants.
